Written to be read. If a clause here is unclear, that is our problem and not yours, so write to us and we will fix the wording.
1. What Firstsong is
Firstsong filters and amplifies the real sound picked up by your iPhone microphone when you rest the phone on your abdomen, and it shows a heart rate only when it has sustained evidence of one. It is a listening app and a keepsake. That is the whole of it.
2. What Firstsong is not, and this part matters most
Firstsong is not a medical device. It is not a doppler and it uses no ultrasound of any kind. It does not diagnose, monitor or screen anything, and it cannot tell you that your baby is well. Nothing it shows, and nothing it fails to show, is a medical result.
Never use Firstsong to decide whether to call your midwife or your doctor. If you feel fewer movements, or anything at all worries you, call them now, whatever the app said or did not say.
3. Silence is a normal result
Fetal heart sounds are faint and easy to miss. Your week of pregnancy, the position of the placenta (an anterior placenta muffles a great deal), where the phone sits, the noise in the room and the headphones you use all change what can be heard at all. Firstsong is built to stay quiet rather than invent a number, so a session that finds nothing is the app working correctly, and it tells you nothing about your baby.
4. Who can use it
You need to be old enough to enter into a contract where you live, and the Apple Account used to buy the subscription has to be yours to use.
5. Your license
We grant you a personal, non-transferable, non-exclusive right to use Firstsong on the devices your Apple Account allows. You may not resell it, rent it, copy it, reverse engineer it or take it apart, except where the law gives you that right anyway.
6. Your recordings are yours
Everything you record belongs to you. We never receive it and we claim no right over it, not to promote the app, not to improve it, not for anything. What you choose to share, and with whom, is your decision and your responsibility.
7. The subscription, and how to leave it
Firstsong is sold as an auto-renewing subscription with two plans, one yearly and one weekly. There is no free trial, so the price you see is the price charged when you confirm. The App Store always shows the exact amount and currency that applies in your country before you buy. At the time of writing the United States prices are 79.99 US dollars per year and 12.99 US dollars per week.
Payment is charged to your Apple Account at confirmation. It renews automatically for the same period unless you cancel at least 24 hours before the current period ends. To cancel, open Settings, tap your name, then Subscriptions. Deleting the app does not cancel anything.
If you reinstall, change device or buy again by mistake, use Restore Purchases. It sits on the paywall and in Settings, it is free, and it needs the same Apple Account you bought with.
Refunds are handled by Apple and only by Apple, at reportaproblem.apple.com. We cannot issue one. Write to us anyway if something went wrong and we will help you put the request in front of the right people.
8. What we promise and what we cannot
We promise that the app processes real sound honestly, that it never plays a recording of somebody else's baby as if it were yours, and that it never displays a number it has not measured. We cannot promise that you will hear a heartbeat on any given night, or at all. That depends on your body and your room, not on the software.
9. Changes to the app
We may update Firstsong, change how a feature behaves or stop offering one. If a change takes away something you have already paid for, you keep it until the end of the period you paid for.
10. Liability
To the extent the law allows, Firstsong is provided as it is, and our total liability to you is limited to the amount you paid for the subscription in the twelve months before the claim. Nothing here limits liability that cannot be limited by law, in particular for death or personal injury caused by negligence, and nothing here takes away the consumer rights your own country gives you.
11. If these terms change
The version and the date at the top say which text applies to you. A material change is published at this address before it takes effect.
12. Governing law, and how to reach us
These terms are governed by the laws of the United Arab Emirates and the courts of Dubai have jurisdiction, without taking away any right you have to bring a claim where you live. Write to firstsong@digitalnafta.com.
